Theft v. Burglary, what is the difference?

Inquiring minds may want to know what the difference between theft and burglary is. Well, the semi-concise answer is that theft involves the unlawful taking of another's property with the intention of permanently depriving them of it, while burglary can involve theft but doesn't necessarily have to. This is so because burglary occurs when a person unlawfully enters a structure or dwelling with the intent of committing a crime, which, of course, could be theft … or any other crime for that matter. In Washington there are three degrees of theft - first, second and third. The degree is based upon the value of the property taken, i.e. theft in the first degree includes property valued at over $5,000. Burglary has two degrees - first and second. If there is a deadly weapon and/or an assault involved, the burglary is considered first degree. Both theft and burglary are punishable by jail time, fine and probation. The amounts of each depend on the degree of the crime alleged.
