Recently the state Senate voted to reduce the per se legal limit in Washington to .05. Once that took place, to become law, the House too had to vote for the lower legal limit. Well, that did not happen, at least this year. The House Community Safety Committee Chair indicated on 3/25/2026 that the bill didn't have enough votes to pass out of the committee. Although the Washington State Patrol has alleged that impaired driving arrests in Washington are on the rise statewide. Other interested parties argued that reducing the per se legal limit to .05 from .08 would not cause those numbers to go down. It appears their arguments, for now, did not go on deaf ears. If it passed, it would've gone into effect on July 1, 2026. For now, Utah remains the only state on our union that has a per se limit below .08.
